said environmental improvement airport, said governors shall jointly carry out the planning for the improvement around the airport.
4. The planning for the improvement around an airport under paragraph 2 shall be in conformity with the planning of the relevant State or local public bodies in relation to plans for the prevention of public nuisance, city planning, and other plans for the preservation of the environment, or for the maintenance or enhancement of the area.

 

(Compensation of Loss)
Article 10. The provider of a specified aerodrome shall, when any person who has previously engaged lawfully in agriculture or other business as specified by Cabinet Order has sustained an operational loss due to the frequent takeoff and landing of aircraft at said aerodrome, make compensation in accordance with the provisions of a Cabinet Order.

 

2. Any loss to be compensated under the provisions of the preceding paragraph shall be for losses actually sustained, not anticipated losses.

 

(Application for Compensation of Loss)
Article 11. Any person who intends to receive compensation (excluding those in reference to New Tokyo International Airport) shall submit an application for compensation of loss to the Minister of Transport through the governor of the City of Tokyo, Hokkaido, or to the relevant Authority with jurisdiction over the area where the dwelling of said person is located, in accordance with the Ordinances of the Ministry of Transport.

 

2. Governors of the urban and rural prefectures shall, when they receive applications under the preceding paragraph, send them to the Minister of Transport accompanied by a letter setting forth their own views.

 

3. The Minister of Transport shall, when having received documents under the preceding paragraph, give notification as to whether or not a loss justifying compensation exists and, in the case when such loss should be compensated, shall decide on the amount of compensation, notifying the applicant of said fact without delay through the governor of the relevant district.

 

(Offer of Objection)
Article 12. Any person who has an objection to the decision made under the provisions of paragraph 3 of the preceding Article may offer such objection to the Minister of Transport in accordance with the procedures specified by the Ordinances of the Ministry of Transport within 30 days of the date following the day on which the said person received notification under the same paragraph.
